What is a QBCC Nominee Supervisor?
A nominee supervisor is the technically qualified person within a company who oversees and takes responsibility for the standard of the company’s building work. They must hold a licence in the same class as the company, and must be an employee, director or secretary of that company.
Does every company need a Nominee Supervisor?
Yes. Any company holding a QBCC contractor-type licence must maintain a nominee who holds the same licence class, for as long as it holds that licence. Without one, the company licence is at risk of suspension or cancellation.
What’s the difference between a Nominee Supervisor and a Site Supervisor?
A nominee supervisor holds responsibility for a company’s contractor-type licence and shares accountability with its directors for compliant, adequately supervised work. A site supervisor is employed to oversee building work of equivalent scope on-site, but has no contracting power and isn’t tied to the company’s licence in the same way.
What’s the difference between a Builder licence and a Trade Contractor licence?
A trade contractor licence covers a specific trade scope and lets you engage other licensees in the same trade or subcontract to a builder. A builder licence covers a much broader scope of work and lets you directly engage trade contractors across different licence classes to coordinate and deliver a project
How can I check if someone holds a current QBCC licence?
QBCC maintains a public Online Licence Search where you can check a licensee’s name, licence class, expiry and any conditions or restrictions. It’s worth checking before relying on anyone’s claimed licence, whether they’re a nominee, contractor or subcontractor.
What happens if a company operates without an active nominee?
A company without a nominee in place can’t lawfully continue trading on its licence. QBCC must be notified within 14 days of a nominee leaving, and a replacement found quickly. Leaving the gap open too long puts the company licence at risk of suspension or cancellation.
Can I simply “rent out” my licence to another company?
No. Lending or “renting” your QBCC licence so another company can trade off it is illegal — known as licence lending or licence borrowing — and both parties can face significant penalties, including loss of licence. If a company needs a nominee, the correct path is a genuine employment, director or secretary relationship with real supervisory involvement.
Why does a company need its own QBCC licence?
A company is a separate legal entity from any individual associated with it, so it needs its own licence to lawfully enter into building contracts. An individual’s personal licence doesn’t extend to a company they own or work for — the company licence, supported by its nominee, is what allows the business itself to contract.
What are the responsibilities of a nominee?
A nominee is responsible for ensuring the company’s work is adequately supervised and meets relevant standards, codes and plans/specifications, coordinating staff and subcontractors on-site, carrying out inspections, and arranging rectification of any defects identified.
Am I personally liable as a nominee?
Yes, to an extent. A nominee shares responsibility with the company’s directors for ensuring building work is compliant and adequately supervised, and can be held accountable — including risk to their own licence — if standards aren’t met.
